Personal Injury Actions
What do you do when you are involved in an accident through no fault of your own?
At the time of the accident:
- Make sure that you are in a safe location before getting out of the vehicle. If you can, do not move the vehicles.
- Check if anyone involved in the accident requires medical attention.
Document the material damage to the vehicles by taking photos. Again, make sure you don’t have to put yourself in danger to take the photos.
- Ensure that you provide and are provided with the details of the other vehicles involved in the accident. Insurance details are always important.
- Try and take the details of any third parties who were also there at the time of the accident. They may become important witnesses later.
- Ensure your vehicle is safe to travel in before continuing on your journey.
- Get your vehicle assessed by a mechanic so that the full extent of the material damage to the vehicle can be discovered.
After the accident:
- It is important to keep clear records. Receipts for doctor and or hospital visits, receipts for any medication or medical equipment you have been advised to take.
You should seek out legal advice by contacting Majella Walsh Solicitors on 021 4757477 or info@majellawalshsolicitors.ie for a confidential chat. Majella Walsh Solicitors will also be able to answer any questions you may have.
You will have to pay for a medical report from your gp. This medical report will be sent with an application form and an application fee to the Personal Injuries Assessment Board (PIAB).
- PIAB will send you to an independent medical doctor to assess your injuries.
- PIAB will either assess the claim and make an offer of an award to compensate you for your injuries or reject the application.
- If PIAB reject the application you can still pursue your claim through the courts.
Material damage caused to the vehicle in the course of an accident which was through no fault of your own can be recoverable in addition to a personal injury claim.
